WHAT TO EXPECT
As Head of Compliance within Global Financial Services, you will be responsible for implementation and ongoing monitoring of a compliance framework (comprising appropriate policies, procedures, systems and controls) designed to ensure compliance with the regulations applicable to Jaguar Land Rover (JLR) financial services and insurance activities.
You will primarily be focused on UK regulations policed by the Financial Conduct Authority (FCA) but you will also collaborate with colleagues across JLR's global markets to monitor compliance with market level financial services and insurance regulations, and share knowledge and best practice.
THE ROLE
Key Responsibilities:
- Ensuring compliance with applicable Financial Services and Insurance (FS&I) regulation in order to protect the interests of JLR
- Developing a Global Financial Services compliance strategy in conjunction with the Head of Legal, Global Financial Services, Global Financial Services senior leadership team, and Group Legal and Compliance team
- Applying working knowledge of FCA requirements and guidance, best practices and industry knowledge to the provision of JLR FS&I activities
- Interpreting FCA principles, rules, regulations and guidance notes relevant to JLR FS&I activities
- Horizon scanning upcoming regulatory changes
- Embedding FCA conduct rules and ethical considerations into policies and procedures guiding employee activities in client dealings and sales practices
- Embedding sales practices completely aligned to the FCA's Consumer Duty principles to minimise mis-selling or other conduct risks
- Effective implementation of policies and procedures for the induction, training and professional development of all employees in risk taking client facing roles
- Critically evaluating day-to-day business activities by risk taking departments to identify potential or actual regulatory breaches
- Pre-empting emerging risk issues through close monitoring before they manifest into incidents
- Drafting, owning, and updating compliance related policies reflecting FCA regulatory standards, including those related to the Consumer Duty
- Managing customer complaints about financial services products, including owning the relationship between JLR and the Financial Ombudsman Service
- Escalation and reporting on complaints and/or breaches to JLR senior management in accordance with FS&I compliance governance framework
WHAT YOU'LL NEED
To be successful in this role you will ideally be a FCA approved SMF16 Compliance Officer or Head of Compliance with demonstrable experience of developing, implementing and monitoring systems and controls for compliance with financial services regulations in FCA solo regulated and/or FCA/PRA dual regulated consumer credit firms or consumer credit brokers.
You will have experience working alongside and reporting to senior stakeholders and have the confidence to challenge and question where needed.
You will need familiarity with:
- UK Consumer Credit Act and associated regulations governing retail lending and consumer hire agreements
- FCA regulations governing credit and insurance intermediaries (i.e. brokerage of regulated credit and insurance agreements)
- FCA regulations governing Appointed Representative arrangements
- FCA Senior Managers and Certification Regime
- FCA Consumer Duty
- Regulatory reporting via FCA Connect and RegData
- Complaints handling for regulated financial services products
- Ability to engage colleagues on regulatory matters with authority and to persuade and influence them
- A pragmatic risk-based approach to compliance
- Compliance experience within a Motor Retailer or Motor Finance provider
- Some knowledge/experience of UK Bribery Act, GDPR/UK DPA 2018, Anti-Money Laundering regulations and sanctions compliance, payment services regulations
